Effective date: September 19, 2026.
SwiftTrail Data Solutions Ltd (Company No. C2026091700015), a company incorporated in Trinidad and Tobago trading as SwiftTrail, respects intellectual property rights. Customers must have the rights or lawful authorization needed to upload and process documents. This policy explains how copyright owners and authorized representatives may report claimed infringement on SwiftTrail and how affected users may submit counter-notices under 17 U.S.C. Section 512.
SwiftTrail's Service processes customer documents in private workspaces. A document does not need to be publicly accessible to be the subject of a report. Identify its location as precisely as reasonably possible; do not access another person's private account or disclose unrelated tenant or financial information to obtain evidence.
Send copyright infringement notices and counter-notices concerning material on SwiftTrail’s Service to:
Email is preferred for prompt handling. However, legally effective written notices and counter-notices received by our designated agent through postal mail will also be handled.
This contact is for copyright matters only. For ordinary customer support, please contact [email protected]
A notice must be in writing and substantially include all of the following:
1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works at a single online site are covered.
3. Identification of the material claimed to be infringing or the subject of infringing activity, a request to remove or disable access to it, and information reasonably sufficient for SwiftTrail to locate it. A URL, account or workspace identifier, file identifier and relevant dates may help where available.
4. Contact information reasonably sufficient for SwiftTrail to reach the complainant, including an address, telephone number and, if available, email address.
5. A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
6. A statement that the notice is accurate and, under penalty of perjury, that the complainant is authorized to act on behalf of the owner of the exclusive right allegedly infringed.
Consider whether a license, fair use or another legal authorization applies before submitting a claim. A knowingly material misrepresentation that material is infringing may create liability under 17 U.S.C. Section 512(f).
SwiftTrail will review notices and act expeditiously to remove or disable access to material where required by the DMCA. We will take reasonable steps to notify the affected user promptly. If essential information is missing, we may request clarification or additional information as appropriate. A failure to satisfy every item does not prevent us from investigating information that gives us actual knowledge of infringement.
We may provide the affected user with the notice and contact details as reasonably necessary to process the claim, comply with law and permit a response. Submit only information necessary for the claim. Removal does not determine the parties' underlying ownership or legal rights.
If you believe your material was removed or access was disabled because of a mistake or misidentification, you may send the agent a written counter-notice containing:
1. Your physical or electronic signature.
2. Identification of the removed material and the location where it appeared before removal or access was disabled.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification.
4. Your name, address and telephone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located. If your address is outside the United States, the statement must consent to jurisdiction in any judicial district in which SwiftTrail, as service provider, may be found. You must also state that you will accept service of process from the person who submitted the original notification or that person's agent.
An email address will help us communicate but does not replace the required information. A counter-notice has legal consequences. Knowingly materially misrepresenting that material was removed through mistake or misidentification may create liability under Section 512(f).
Upon receiving a counter-notice satisfying the applicable statutory requirements, SwiftTrail will promptly provide a copy to the original complainant and inform that person that access will be restored in 10 business days. SwiftTrail will restore the material or access no earlier than 10 and no later than 14 business days after receipt, unless the designated agent first receives notice that the complainant has filed an action seeking a court order restraining the user's infringing activity relating to that material, or another independent legal basis requires continued restriction.
SwiftTrail will terminate, in appropriate circumstances, accounts of subscribers or account holders who are repeat infringers. SwiftTrail accommodates and does not interfere with standard technical measures within the meaning of Section 512(i). We may also restrict material or accounts for separate violations of the Terms or applicable law.
This policy addresses copyright claims. Other intellectual-property, privacy or security concerns may be sent to [email protected]. Nothing here guarantees eligibility for a statutory safe harbor or limits lawful remedies. The applicable federal requirements govern DMCA notices and counter-notices; the Terms' general dispute provision does not alter the counter-notice jurisdiction statement required above.
